Abstract

This training will cover how you can be held accountable for "Deletions". Based on a "LandMark Case", my client was "Sanctioned" for deleting relevant Electronically Stored Information (ESI) that was order by the court to be put on "Litigation Hold". The value of the ESI deleted material was relevant in accurately accessing total damages.

With "Post Mortem" Computer Forensic techniques, we can view electronically stored information that is typically not available to view when a computer is in use, such as:

  1. When did a deletion occur?
  2. Where did files reside prior to deletion?
  3. How many files were deleted?
  4. Are the files recoverable?
  5. What are possible names of the files deleted?

Computer Forensics is an art and a science. It should be used whenever you believe your electronic data has been compromised, or whenever the "Corporation" that you work for is handed a "Court Order" along with a "Preservation Order" to "Hold" and "Produce" all electronically stored information (ESI).
